Case

Arion and Versania, neighboring countries and WTO members, faced a dispute when Arion's pharmaceutical company, ANCOP, started producing COVID-19 vaccines with Arion's authorisation, which it then exported to a third country, Boutica. This prompted Versania‘s concerns regarding an infringement of Versania's patent rights and ultimately led to Versania seizing and destroying the shipments with Arions vaccines, once it entered Versania’s territories for transit to Boutica. The seizure and destruction was challenged by Arion before the WTO Dispute Settlement Body. The moot problemMoot problem raised a series of WTO law-related questions related to intellectual property rights and the freedom of transit.
